Usage Licence Terms

These License Terms explain how you are allowed to use any digital murder mystery game (“Game”) purchased from My Mystery Kit (“we”, “us”, “our”). By purchasing, downloading, accessing, or using a Game, you agree to these terms.
These License Terms sit alongside our general Terms & Conditions and Refund Policy. If there is a conflict, these License Terms apply to how the Game can be used.
1. License Grant
When you purchase a Game, you are buying a limited license, not the copyright in the Game.
Subject to these terms and the License Type you select at checkout, we grant you a non-exclusive, non-transferable license to:
- download the Game materials; and
- use them to host one event matching your selected License Type.
You do not own the Game and you do not acquire any rights to copy, resell, or adapt it except as expressly allowed below.
2. License Types
You must choose the License Type that accurately reflects how the Game will be used.
2.1 Personal Use
- For private events hosted by an individual.
- Attendees are family, friends, or invited guests.
- No ticket sales, fundraising, sponsorship, or public advertising.
- No connection to a business, organization, club, or venue.
2.2 Workplace Use
- For internal events run by a business, company, or organization.
- Attendees are employees, contractors, or members of that organization.
- No ticket sales or revenue from entry.
- Not open to the general public.
2.3 Non-Profit Use
- For registered charities, schools, and similar non-profit organizations.
- May be used for fundraising or internal community events.
- We may ask for proof of non-profit / charity / school status.
- If you are not a genuine non-profit, you must choose a different License Type.
2.4 Ticketed Event
- For any event where tickets are sold, entry is paid, or the Game is used as part of a paid offering (for example: venue packages, public events, commercial entertainment).
- May be used for events open to the public or a paying audience.
- One Ticketed Event license covers one event date at one location, unless we agree otherwise in writing.
3. What You Can Do
Under your selected License Type, you may:
- Print or duplicate Game materials only as needed for your single event (for example, one copy per player or per team).
- Make minor practical adjustments for hosting (for example, printing in black and white, reorganising pages, or inserting your guest names where our instructions allow).
- Promote your event in line with your License Type:
- Personal / Workplace: private invites, internal channels.
- Non-Profit / Ticketed: public promotion is allowed, but you must not share spoilers or full game content.
4. What You Cannot Do
You agree that you will not:
1. Copy or redistribute the Game
- No reselling, gifting, uploading, or sharing Game files or links so others can host their own event without buying a license.
- No bundling the Game into any other product or service you sell, unless covered by a Ticketed Event license and permitted by us in writing.
2. Create derivative works
- No rewriting plots, endings, or key story elements.
- No creating new products, kits, or experiences based on our Game materials.
- No translation into other languages without our written permission.
Minor cosmetic changes (such as using guest names where our kit allows customisation) are fine. Re-theming or rebuilding the Game is not.
3. Exceed your License Type
- No using a Personal, Workplace, or Non-Profit license for any paid or ticketed event.
- No using Workplace or Non-Profit licenses for events where the main purpose is selling tickets or packages.
- No using a single license to cover multiple separate events, dates, or locations without our written consent.
4. Publicly share spoilers or core content
- Do not post solutions, endings, secret clues, or full scripts online (including social media, livestreams, YouTube, blogs, or similar).
- Photos of people playing, costumes, decor, and non-spoiler shots are fine and encouraged.
5. Transfer or lend your license
- Licenses are for the original purchaser / organisation only and cannot be transferred or sold on.
6. Misuse, Upgrades, and Enforcement
By choosing a License Type at checkout, you confirm that it accurately reflects your intended use.
If we reasonably believe you have:
- selected a lower-priced License Type than required; or
- used the Game outside the scope of your License Type,
we may, at our discretion:
- require you to pay the difference between the License you purchased and the License you should have purchased;
- require you to purchase the correct License for past or future use;
- suspend access to future purchases or support; and/or
- treat this as a breach of these License Terms and revoke your license without refund.
We may also take further steps to protect our intellectual property where necessary.
6. Intellectual Property
All Games and related content are owned by My Mystery Kit or our licensors and are protected by copyright and other intellectual property laws.
Except for the limited license granted under these terms:
- you do not obtain any ownership of the Game or any artwork, text, or other content; and
- all rights not expressly granted are reserved.
If you become aware of unauthorised copying, sharing, or misuse of our Games, you agree to notify us.
7. No Warranty
Games are provided on an “as is” basis. To the maximum extent permitted by law, we:
- do not guarantee that a Game will be error-free or suitable for your specific event; and
- are not responsible for issues arising from how you host or run the event.
Nothing in these terms excludes any non-excludable rights you have under Australian consumer law or other applicable consumer protection laws.
8. Limitation of Liability
To the maximum extent permitted by law:
- our total liability to you for any claim connected to a Game or these License Terms is limited to the amount you paid for that Game; and
- we are not liable for any indirect, special, or consequential loss (including lost profits, loss of opportunity, or damage to reputation) arising from your use of a Game.
9. Changes to These License Terms
We may update these License Terms from time to time. The version in force at the time you purchase a Game will apply to that purchase. We will note the “Last updated” date at the top of this page.
10. Governing Law
These License Terms are governed by the laws of New South Wales, Australia, and you agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and any courts that may hear appeals from those courts.
